Solicitors – representatives of law and justice

Solicitors are the professionals who advise and represent their clients in all legal matters. You can work in a private practice (such as law firms), for the government or for a non-profit. In court proceedings, they represent the interests of their clients and, at the same time, as organs of the administration of justice support the judges in finding justice.

Solicitors often specialise in a particular area of law, such as family law, labour law or criminal law. Regardless of the field of law in which they operate, they must have a thorough knowledge of the relevant legislation and case law.

The work of representatives of the law is demanding, but can also be very rewarding. In addition to excellent analytical skills, above all, solicitors should be able to think strategically. Oral and written communication that gets straight to the point is of equal importance. The teamwork skills of a solicitor are also important in order to be able to work together efficiently and purposefully in a group.

What does a solicitor do?

Solicitors play a major role in our society because they support people and companies in important legal matters. Depending on their specialisation, they work in various areas and assist their clients from legal advice to the drafting of a will and defence in court. You can deal with a variety of legal matters, including criminal law, family law, property law as well as contract law, insurance law or medical law.

Solicitors must be able to think quickly and critically, to understand complex facts and contexts and thus to solve problems. In addition to dealing with the current law, they should be able to communicate effectively with their clients, competent judges and other solicitors.

What is the difference between a legal counsellor and a solicitor?

Again and again, the terms legal counsellor and solicitor are used synonymously. However, the two are fundamentally different. While legal counsellors do not have to be solicitors, but represent the interests of other people, solicitors are per se lawyers. They have successfully completed both state examinations and have been admitted as a lawyer by the competent bar association. Over the course of your career, you will often specialise in one area of law such as migration, social or transport law.

Duties as a lawyer

The tasks of a solicitor cover a variety of different areas of law. Accordingly, the everyday life of a solicitor is characterized by the following tasks:

  1.
  2. Drafting and negotiating business agreements and contracts.

  3.
  4. Negotiating out-of-court settlements in litigation.

  5.
  6. Clients represented in court.

  7.
  8. Enforce case-specific claims.

  9.
  10. Obtaining witness statements and collecting evidence.

  11.
  12. Formulate legally valid documents.

  13.
  14. Formally handle legal action.

  15.
  16. Communication with other legal bodies such as lawyers of the opposing party and the judge.

What is the salary of a solicitor?

How much you earn as a solicitor cannot be said in general. Because whether solicitors are active in companies, in law firms or independently in legal advice, part-time or full-time, is also shown on their respective pay slip. Professional experience and whether or not they assume personnel responsibility is equally decisive.

For beginners in legal advice, a monthly gross salary of EUR 3,700 can be expected as an employee in a law firm. Large firms, on the other hand, already offer EUR 6,000 to 10,000 gross per month. On the other hand, self-employed lawyers often earn significantly less.

During the course of your career, the salary increase basically has no limits, so solicitors can thereby be among the absolute top earners in Germany.

If you want to become a lawyer, you cannot avoid studying law, including the first state examination, legal clerkship and the subsequent second state examination.

Studying law is not an easy task. Nine semesters of hard work are necessary to obtain the first state examination. The programme is divided into four basic semesters and five main semesters, in which prospective lawyers specialise in the field of law they are striving for. After completing all courses and examinations, they receive the first state examination in law. Anyone who sets themselves the goal of becoming a lawyer, public prosecutor or even a judge must then carry out the two-year legal clerkship at a higher regional court. For all trainee lawyers, successful completion means the second state examination and thus the ability to work as a solicitor, for example. You may then also call yourself a fully qualified lawyer.

The often cherished desire to study law and ultimately to work as a solicitor is reflected in the increasing number of enrolled law students. Even if this fact sounds like high competitive pressure at first, the opportunities on the job market are good for solicitors. Although the number of law students is increasing, the number of those who actually complete a second state examination and thus complete the qualification as a lawyer is decreasing at the same time.

In addition, the industry is exposed to constantly changing topics and focal points that arise from social developments and digitisation in all areas. Thus, for example, areas such as data protection law or copyright law are becoming increasingly important for companies, which leads to a higher demand for specialised solicitors.
