Which legal requirements justify the obligation to have a sustainable supply chain?

The obligation to have a sustainable supply chain is a legal requirement that encourages companies to organise their supply chains in an environmentally friendly and socially responsible manner.

The Lieferkettengesetz (LkSG) currently applies in Germany, which obliges companies with more than 1,000 employees to identify and minimise human rights and environmental risks in their supply chains. With the introduction of the Corporate Sustainability Due Diligence Directive (CSDDD) by the European Union, the responsibility of companies for their global supply chains has been further tightened.

What is the CSDDD?

The CSDDD (or CS3D) was adopted in 2024 and is aimed at large companies within the European Union as well as companies from third countries operating in the EU. It specifically, applies to:
  • EU companies with more than 1,000 employees and a global turnover of more than 450 million euros.
  • Third-country companies that generated net sales of more than 450 million euros in the EU in the previous financial year.

What sanctions are used to enforce the CSDDD?

Penalties: Penalties of up to 5% of a company's global annual turnover can be imposed for non-compliance with due diligence obligations (compared to a maximum of 2% under the LkSG).
Civil liability: The Member States are obliged to introduce civil liability regulations that enable those affected to assert claims for damages against companies.  
Compensation: In contrast to the LkSG, the CSDDD explicitly demands financial compensation for those affected in the event of proven damage.
