What is temporary employment?
Temporary employment consists of three interrelated pillars providing mutual benefits and complying with certain contractual regulations. The temporary employment agency (Hays) plays a central role as a staffing agency. We have permanent (temporary) employees whose work we "lend" to companies (hirers) for a fixed period of time. Contracts are concluded between the (temporary) employees and Hays as well as between Hays and the company (hirer). (Temporary) Employees and the user company do not conclude a contract. Only the services provided by the temporary agency workers to the company take place.
Our co-operation is based on the Temporary Employment Act (AÜG).This regulates essential issues for all parties involved in temporary employment (employees, staffing agencies and hirers) such as the rights and obligations of each party, the type and duration of employment, as well as fair remuneration of the employee. In this way, we combat illegal forms of temporary employment and champion the honest use of temporary staff.
Our experts will be happy to advise you on all questions relating to temporary employment, your options and areas of application.

Questions about temporary employment
Since the new Temporary Employment Act (AÜG) came into force in April 2017, an upper limit has been set for the duration of temporary agency work. Since then, temporary agency workers have been allowed to carry out the same activity with a hirer for a maximum of 18 months. At the end of this period, the respective company can take over the temporary worker either in permanent employment – but then with a contract between employer and employee. However, the company is also allowed to fill the same job with new temporary workers.

Yes, through collective agreements or company agreements, temporary agency workers can also be loaned beyond the 18-month period. In these cases, even a temporary employment contract with a term of several years is possible.
According to the Temporary Employment Act (AÜG), every company wishing to borrow staff must submit an application for temporary employment to the competent Federal Employment Agency. A corresponding authorisation (Temporary Employment Act (AÜG) permit or Temporary staffing (ANÜ) license) will then be granted. Hays has this permission as a borrower and is thus able to lend temporary staff to hiring companies for a specified period of time.

Temporary employment exists when a hiring company lends a temporary worker to another company (hirer). In each case, the lending company concludes a contract with the temporary worker and with the hiring company. This is particularly advantageous for hirers if there is a holiday-related shortage of staff, or an unexpectedly high level of illness in the company. Even if skilled workers are only needed for a certain period of time, temporary employment is a flexible way to quickly deploy specialist personnel for a limited period of time.

As with any serious employment relationship, the working conditions are regulated in the employment contract. The rights of temporary workers and the associated obligations of agencies and hirers are regulated by the Temporary Employment Act (AÜG).
This regulates, among other things:
- Permit requirements for temporary commercial employment
- Time limits of the assignment
- Financial equality with comparable permanent employees.

In principle, temporary agency workers have the right to the same remuneration that the hirer would pay to a comparable permanent employee. There is no entitlement to collectively agreed payment.
